For your information: “GiftyBuddy Private Limited”, is a company incorporated under the Companies Act, 2013 with its registered office (hereinafter referred as “We”/ “GiftyBuddy”/ “Us”/ “Our”).
For abundant clarity, GiftyBuddy and/ or the trademark "giftybuddy" are neither related, linked or interconnected in whatsoever manner or nature, to any other third-party businesses.
The terms and conditions/ terms of use ("Terms") governing the GiftyBuddy Platform (defined later) and the Services (defined later) follow:
ACCEPTANCE OF TERMS
These Terms are intended to make you aware of your legal rights and responsibilities with respect to your access to and use of the GiftyBuddy’s website and/or any related mobile or software applications (collectively referred to as, “GiftyBuddy Platform”) including but not limited to the services offered by GiftyBuddy via the GiftyBuddy Platform or otherwise ("Services").
Your use/ access of the GiftyBuddy Platform shall be governed by these Terms and the Privacy Policy of GiftyBuddy. By accessing the GiftyBuddy Platform and/ or undertaking any sale-purchase transaction, you agree to be bound by the Terms including any additional terms and conditions and policies referenced herein and acknowledge that it constitutes an agreement between you and GiftyBuddy.
These Terms may be updated from time to time without notice. It is strongly recommended that you review these Terms regularly.
The terms ‘visitor(s)’, ‘user(s)’, ‘you’, ‘your’, ‘customer(s)’ refer to any person using the platform.
SERVICES OVERVIEW
GiftyBuddy Platform is a platform for users/ consumers to transact with sellers/ service providers offering products/services for sale/ supply.
Products/ services may be listed by GiftyBuddy, its affiliates or third parties (“Third Party Sellers”).
GiftyBuddy is not and cannot be a party to any transaction between you and Third Party Sellers. We do not control or guarantee quality, suitability, or availability of products/services.
All transactions are at your own risk.
ELIGIBILITY
Persons who are “incompetent to contract” under Indian Contract Act, 1872 (including minors) are not eligible.
If you are under 18, you may use the platform under supervision of a parent/guardian.
Platform is intended for personal use only, not for business or wholesale use.
ACCOUNT & REGISTRATION OBLIGATIONS
All users must register to place orders.
You must provide accurate information including:
Name
Phone number
Address
You agree to receive communications via SMS, email, or app notifications.
We may collect user data including personal and transactional information as per our Privacy Policy.
LIMITED LICENCE & ACCESS
GiftyBuddy grants a limited, non-exclusive, non-transferable license for personal use.
You shall not:
Copy or modify platform content
Use for commercial resale
Use bots/data mining tools
PROHIBITED CONTENT
You agree NOT to upload/share any content which:
Is illegal, abusive, obscene, or harmful
Violates any law
Infringes intellectual property
Contains viruses or malicious code
Impersonates another person
Misleads or spreads false information
Any violation may result in termination of access.
ADVERTISING
Platform may contain ads or promotional content from third parties.
GiftyBuddy is not responsible for:
Third-party offers
Transactions with advertisers

Users must treat delivery partners respectfully.
CUSTOMER COMMENTS, REVIEWS, RATINGS

You acknowledge and agree that the GiftyBuddy Platform and the Services are provided "as is" and "as available" and that your use of the GiftyBuddy Platform and the Services shall be at your sole risk. To the fullest extent permitted by applicable law, GiftyBuddy, its group companies, affiliates, and their respective directors, employees, officers, agents and representatives (“GiftyBuddy Parties”) disclaim all warranties, express or implied, in connection with the GiftyBuddy Platform and the Services and your use of them.
To the fullest extent permitted by applicable law, GiftyBuddy makes no warranties or representations that the GiftyBuddy Platform and the Services have been and will be provided with accuracy or completeness of the content and assume no responsibility for any errors, inaccuracies, or omissions in the content or services. Any material downloaded or otherwise obtained through the use of the GiftyBuddy Platform is done at your own discretion and risk.
GiftyBuddy shall not be responsible for any unauthorized access to or use of its servers and/or any personal information stored therein, or for any interruption or cessation of transmission to or from the platform. GiftyBuddy shall also not be liable for any bugs, viruses, or other harmful components that may be transmitted through the platform.
You are solely responsible for all of your communications and interactions with other users and third parties through the GiftyBuddy Platform. No advice or information obtained from GiftyBuddy shall create any warranty unless expressly stated.
DELIVERY PARTNERS
We facilitate delivery of orders through independent contractors, referred to as delivery partners. These delivery partners are not employees or agents of GiftyBuddy and operate on a principal-to-principal basis.
GiftyBuddy shall not be held liable for any acts, omissions, delays, or misconduct of delivery partners.
Users are expected to treat delivery partners with respect and dignity. Any inappropriate behavior may result in restriction or termination of access to the platform.
CUSTOMER COMMENTS, REVIEWS, RATINGS
"Comments" include reviews, feedback, images, videos, and any other content shared on the GiftyBuddy Platform.
By submitting any content, you grant GiftyBuddy a worldwide, non-exclusive, royalty-free license to use, publish, display, and distribute such content for any purpose.
You agree that your content will not violate any laws or third-party rights and will not contain any harmful, offensive, or misleading material.
GiftyBuddy reserves the right to remove or modify any content without prior notice.
You are solely responsible for the content you submit.
CUSTOMER FEEDBACK
If you provide suggestions, ideas, or feedback to GiftyBuddy, you agree that such feedback is non-confidential and becomes the property of GiftyBuddy.
GiftyBuddy shall be free to use, modify, and implement such feedback without any compensation or obligation to you.
INTELLECTUAL PROPERTY
All content on the GiftyBuddy Platform, including text, graphics, logos, and software, is the property of GiftyBuddy or its licensors and is protected by applicable intellectual property laws.
You may not copy, reproduce, modify, distribute, or use any content without prior written permission from GiftyBuddy.
PRIVACY POLICY
GiftyBuddy respects your privacy and handles your personal data in accordance with its Privacy Policy.
By using the platform, you consent to the collection, storage, and use of your information as described in the Privacy Policy.
INFORMATION DISCLOSURE
While GiftyBuddy takes reasonable measures to protect your data, it cannot guarantee complete security of information transmitted over the internet.
By using the platform, you agree that GiftyBuddy shall not be liable for any unauthorized access or disclosure of your information.
MISREPRESENTATION
GiftyBuddy shall not be responsible for any unauthorized communications, fraudulent activities, or misrepresentations made by third parties.
GiftyBuddy will never ask for sensitive information such as OTP, passwords, or banking details. Users are advised to remain cautious and report any suspicious activity.
USER RESPONSIBILITIES
You agree to provide accurate and complete information while using the GiftyBuddy Platform.
You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.
GiftyBuddy shall not be liable for any loss or damage arising from incorrect information provided by you or misuse of your account.
TAXES
All applicable taxes, including GST, will be charged as per prevailing laws.
Final pricing may vary depending on discounts, offers, or changes in tax rates.
Invoices will be provided as per applicable legal requirements.
ORDER CANCELLATION
You acknowledge that (a) your cancellation, or attempted or purported cancellation of an order or (b) cancellation due to reasons not attributable to GiftyBuddy, shall amount to your breach of the Terms and any such request shall be permitted subject to acceptance of the same by GiftyBuddy.
For any permitted cancellations, we will initiate a refund, if any, against the relevant product/ order, which may be in the form of promotional codes/ coupons which shall be available for use against a subsequent invoice for transactions on the GiftyBuddy Platform, in accordance with the specified terms, if any, such as validity period.
Orders may be cancelled by GiftyBuddy in any of the following cases:
(a) if it is suspected that a customer has undertaken a fraudulent transaction, or
(b) if it is suspected that a customer has undertaken a transaction which violates these Terms, or
(c) in case of unavailability of product(s), or
(d) for any reason outside the control of GiftyBuddy, including technical errors or delivery-related logistical difficulties.
For such cancellations, GiftyBuddy will initiate a refund, if any, against the relevant product/ order within approximately 72 hours.
Further, GiftyBuddy aims to ensure that availability status, specifications and prices of all products/services are accurate. However, in case of technical issues, typographical errors or incorrect information provided by third-party sellers, GiftyBuddy reserves the right to cancel the order and initiate a refund in the form of credit/ cashback/ coupon/ promotional codes.
GiftyBuddy reserves the right to deny access to users involved in non-compliance or fraudulent transactions.
RETURNS & REFUNDS
Products once delivered/ services once fulfilled are non-returnable, non-replaceable, non-exchangeable and non-refundable, except:
(a) if the product is damaged, defective, expired or incorrectly delivered, or
(b) where the specific product policy allows return/refund under defined conditions.
Users must check product-specific policies before placing an order.
Proof such as images/videos may be required before processing any request.
No refunds will be provided if delivery fails due to customer-related reasons such as:
For digital goods (gift cards, vouchers), no return/refund applies. Users must contact the respective issuer for issues.
All approved refunds will be processed within 7 working days.

Cash on delivery refunds will be issued only as promotional codes (valid for 30 days).
All refunds will be processed in Indian Rupees only.
GIFTYBUDDY CASHBACK
Cashback refers to credits added to the user’s GiftyBuddy account and does not mean cash refund to bank/card.
Cashback may be:
No cashback is applicable on cancelled orders.
GiftyBuddy may recover cashback if an order is refunded.
Cashback will reflect within 24–48 hours (or up to 7 days in some cases).
Validity:
GiftyBuddy reserves the right to modify or cancel cashback offers at any time.
EMI ON CREDIT AND DEBIT CARDS
These EMI Terms apply to all EMI transactions on the GiftyBuddy Platform.
EMI facility is provided by issuing banks. GiftyBuddy has no role in:

Users must follow bank terms and contact the bank for any EMI-related queries.
If order is cancelled before EMI conversion → full refund.
If after EMI conversion → bank charges/taxes are non-refundable.
GiftyBuddy does not charge any EMI processing fee.
NO COST EMI ON CREDIT CARDS
Under No Cost EMI:
You receive an upfront discount equal to the interest cost.
Applicable conditions:
GiftyBuddy is not responsible if bank declines EMI.
Late payments may incur penalties by bank.
No refund on interest already charged.
GiftyBuddy reserves the right to modify/cancel the offer anytime.
PROMOTIONAL TERMS
These terms apply to promotional campaigns (“Promo Offer”) on GiftyBuddy Platform.
Eligible Customers are those who meet the criteria set by GiftyBuddy.

PAYMENT FACILITY AND RELATED INFORMATION
All the payments towards the orders and/or any services shall be compulsory in Indian Rupees only.
The information with respect to the accepted payment methods on the GiftyBuddy Platform shall be displayed at the time of making payment for an order which may include but not limited to credit card or debit card; net banking; UPI; cash on delivery or any other RBI approved payment mode as may be reflected on the GiftyBuddy Platform from time to time. Cash on delivery may not be permitted for certain orders.
To facilitate the payments, you acknowledge and agree that GiftyBuddy may use certain third party vendors and service providers, including payment gateways, to process payments and manage payment card information. If you are directed to any third party payment processor, you will be subject to terms and conditions governing use of that third party’s service and we shall have no liability towards the same.
With respect to the payment details provided by you to avail the payment facility, you represent, warrant and covenant that you are legally entitled and/or authorized to provide such payment details and make payments using such payment details. You shall be solely liable for the payments done through payment details and you confirm that use of such payment details by you does not violate any applicable law.
The payment facility provided by GiftyBuddy is neither a banking nor a financial service but is merely a facilitator providing an electronic, automated online electronic payment system, and receiving payment on orders placed at GiftyBuddy Platform using the existing authorized banking infrastructure and card payment gateway networks, as may be applicable.
You agree and confirm that in respect to certain payment methods, the respective issuer may charge you an additional fee i.e. transaction fees or other fees, for the purpose of processing your payment transaction.
ORDER HISTORY
If you delete an order from your order history through your account on the GiftyBuddy Platform, your order details will no longer be visible to/ accessible by you through your account. To clarify, for orders placed for someone else, your action shall not impact visibility of the order details as accessible through that person’s account, where the order details were available.
You understand that your action shall be irreversible and no support will be offered on such deleted order(s) including complaints, retrieval/ information/ invoice request, cancellation, return, replacement, or exchange.
Order once deleted will however remain present in GiftyBuddy's records in accordance with the Privacy Policy and be subject to records retention policies and applicable law.
INTERNATIONAL USERS
“International Users” shall mean such users who have registered on the GiftyBuddy Platform using a permitted mobile number registered outside of India, and wish to avail the Services.
To place an order, you will be required to provide the recipient’s contact details, such as name, phone number registered in India, address or any other information required to enable delivery.
Certain features of the GiftyBuddy Platform may not be available to International Users.
Services may be available only for selected products/services.
Payments may include international cards and additional charges like currency conversion charges which shall be borne by you.
GRIEVANCE REDRESSAL MECHANISM

INDEMNITY
You agree to indemnify, defend, and hold harmless GiftyBuddy, its affiliates, directors, employees, and partners from and against any third party claims, damages, losses, liabilities, costs and expenses arising out of:

LIMITATION OF LIABILITY
GiftyBuddy shall not be liable for any indirect, incidental, special, or consequential damages including loss of profit, data, or business.
Maximum liability shall not exceed the amount paid by you for the order in question.
TERMINATION
GiftyBuddy reserves the right to terminate or suspend your account without notice if:

GOVERNING LAW & JURISDICTION
These Terms shall be governed by laws of India.
Courts shall have jurisdiction as per applicable Indian laws.
MISCELLANEOUS
PRINTING SERVICES
For availing the printing services, customers have to upload a soft copy of the document, file, data, text, image, etc. in printable format (“Print Document(s)”) on the GiftyBuddy Platform or trigger the printing request for documents available on the platform. Upon receiving your request, the Print Document(s) will be printed and delivered to you.
You agree not to upload any Print Documents that fall within the parameters of Prohibited Content.
While we endeavour to protect the confidentiality of Print Document(s) uploaded, you shall upload the Print Document(s) at your own risk. You are advised not to upload documents which you consider confidential.
We do not store any Print Document(s). Documents shared are only temporarily maintained for providing printing services.
You may be charged a printing fee which will be shown at the time of placing the order. By placing the order, you agree to pay the applicable charges. We reserve the right to change fees anytime.
We reserve the right to share Print Document(s) with affiliated/franchise stores for printing and delivery.
If defects are found in printouts, customers must report within 24 hours with proof. Complaints after 24 hours may not be entertained.
The customer agrees to use printing services only for lawful purposes.
Uploading documents implies consent to use data as per Terms and Privacy Policy.
Printing services are used at your own risk.
THIRD PARTY ANCILLARY SERVICES
To improve user experience, GiftyBuddy or third-party sellers may collaborate with third parties (brands, vendors, service providers).
These services (like installation, demo, etc.) are provided by third parties under their own terms.
GiftyBuddy has no control over quality or service completion and provides no guarantees.
If issues arise, users must contact the respective service provider.
By opting for such services, you consent to share your personal and order details with third-party providers.
Services may be affected due to operational issues like traffic, weather, incorrect info, etc.
You agree that using such services is at your own risk and GiftyBuddy is not liable.
GIFTING SERVICES
You may place an order for products to be delivered as a gift.
Gifting is available only for selected products (“Eligible Gift Products”).
You agree to send gifts only to known persons and not misuse the service.
To place a gift order, you must provide recipient details (name, phone, address).
You confirm that you have recipient consent for sharing their details.
You agree not to harass or misuse gifting services.
If the recipient is unavailable, we may contact you.
Gifting fees may apply and will be shown before placing the order.
Payment may be required in advance.
Gift messages may be delivered but are not guaranteed.
GIFTYBUDDY GIFT CARDS
GiftyBuddy gift cards are prepaid instruments issued by authorized partners under RBI guidelines.
Gift cards can be used only on the GiftyBuddy Platform.
They can be purchased using credit card, debit card, UPI, or net banking.
Gift cards are valid for 1 year and cannot be redeemed for cash.
Multiple gift cards can be used in one order.
In case of cancellation, amount will be refunded as GiftyBuddy balance.
Users are responsible for keeping gift cards safe.
Fraudulent purchases may lead to cancellation.
KYC details may be required as per RBI rules.
Expired cards may be revalidated within 1 year.
Disputes will be governed under Indian law.
